These Terms of Service (“Terms”) govern your access to and use of our Site and any products, programs, coaching, content, communications, communities, and related services we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
1) Who We Are (Educational Coaching)
ImmunoFit provides education, coaching, and guidance related to training, nutrition, habits, recovery, and performance. We are not a medical provider, hospital, or emergency service.
2) Eligibility
You must be at least 18 years old (or the age of majority where you live) to purchase or use the Services. By using the Services, you represent you meet this requirement.
3) Health Disclaimer (Not Medical Advice)
The Services are for educational and informational purposes only and are not medical advice, diagnosis, or treatment.

Always consult a physician or qualified healthcare provider before starting a new exercise program, changing diet, or if you have any medical condition, injury, or symptoms.

Do not use the Services for emergencies. If you think you may have a medical emergency, call 911 (or your local emergency number).
You acknowledge that any decisions you make based on the Services are your responsibility.
4) Assumption of Risk
Physical training and lifestyle changes carry inherent risks, including injury, illness, or adverse outcomes. By using the Services, you voluntarily assume all risks associated with:

Exercise and physical activity

Nutritional changes

Supplement use (if you choose to use supplements)

Lifestyle modifications (sleep, stress, recovery protocols)
You agree to stop any activity that causes pain, dizziness, or discomfort and seek medical advice as needed.
5) No Guarantees / Results Vary
We do not guarantee specific results (fat loss, muscle gain, performance, biomarkers, energy, etc.). Results depend on many factors including consistency, genetics, sleep, stress, medical conditions, and adherence.
6) Service Delivery & Client Responsibilities
Depending on what you purchase, Services may include programming, check-ins, feedback, asynchronous messaging support, educational materials, and accountability. The exact deliverables are as described on the checkout page or product description at the time of purchase.
You agree to:

Provide accurate, honest information in intake forms and check-ins

Communicate injuries, conditions, or limitations

Follow safe form and technique practices

Take responsibility for your choices and compliance
If you fail to provide required information (e.g., onboarding data, check-ins), your results may suffer and we are not responsible for missed progress.
7) Accounts & Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you believe your account has been compromised.
8) Payments, Billing, and Taxes
You agree to pay all fees displayed at checkout, including any applicable taxes. Prices may change at any time for future purchases; changes do not affect purchases already made.
We may use third-party payment processors. Your payment is subject to the processor’s terms as well as ours.
9) Subscriptions, Renewals, and Cancellation (If Applicable)
If you purchase a subscription:

Your subscription may renew automatically until canceled.

You are responsible for canceling before renewal to avoid future charges.

Canceling stops future billing; it does not automatically refund past charges.
Cancellation instructions will be provided at checkout, in your account, or in your purchase confirmation. You can also email info@immunofithealth.com for assistance.
10) Refunds (30-Day Money-Back Guarantee)
Refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. If there is any conflict between these Terms and the Return & Refund Policy regarding refunds, the Return & Refund Policy controls.
Refund requests must be submitted to info@immunofithealth.com within the required time window and subject to eligibility requirements listed in the policy.
11) Chargebacks & Disputes
If you have a billing issue, contact info@immunofithealth.com first so we can resolve it.
Initiating a chargeback without contacting us may be treated as a breach of these Terms and may result in termination of access. We reserve the right to provide documentation to payment processors to contest fraudulent or abusive chargebacks.
12) Intellectual Property & License
All content and materials provided through the Services—including workouts, templates, PDFs, videos, text, graphics, and program structures—are owned by ImmunoFit or our licensors and are protected by intellectual property laws.
Limited license: When you purchase the Services, you receive a limited, non-exclusive, non-transferable, revocable license to use the materials for your personal, non-commercial use only.
You may not:

Copy, reproduce, sell, license, distribute, or share our materials

Create derivative products or competing services using our materials

Post paid materials publicly or share login access
13) Community Rules & Conduct (If You Have a Group)
If you participate in any ImmunoFit community (group, forum, chat), you agree to:

Be respectful and professional

Not harass, threaten, or demean others

Not post illegal, explicit, or harmful content

Not solicit clients or spam
We may remove content or terminate access for violations, with or without notice.
14) Prohibited Uses
You agree not to:

Use the Services for unlawful purposes

Interfere with or disrupt the Site or systems

Attempt unauthorized access to accounts or data

Scrape, reverse engineer, or exploit the Services
-
Impersonate others or misrepresent your identity
15) Testimonials & User Content
If you submit testimonials, reviews, photos, videos, check-ins, or other content (“User Content”), you grant ImmunoFit a worldwide, royalty-free license to use, reproduce, modify, and display that content for business purposes (marketing, education), unless you explicitly revoke permission in writing.
We will not intentionally publish highly sensitive health details without consent, but you are responsible for what you choose to submit.
16) Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use data.
17) Third-Party Services
We may link to or integrate third-party services (payment processors, scheduling tools, analytics, messaging platforms). We are not responsible for third-party services, and your use of them is governed by their terms.
18) Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:

The Services will be uninterrupted or error-free

Any outcomes will be achieved

Any information is complete or suitable for your specific situation
19) Limitation of Liability
To the maximum extent permitted by law, ImmunoFit and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising from your use of the Services.
To the maximum extent permitted by law, our total liability for any claim related to the Services will not exceed the amount you paid to ImmunoFit for the specific Program giving rise to the claim in the three (3) months before the event that triggered the liability.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you fully.
20) Indemnification
You agree to indemnify and hold harmless ImmunoFit from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or related to:

Your use of the Services

Your breach of these Terms

Your violation of any law or third-party rights

Your misuse of training/nutrition recommendations
21) Arbitration & Class Action Waiver (Strong Protection Clause)
Please read carefully. This affects your legal rights.
Unless prohibited by law, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, not in court, except you may bring qualifying claims in small claims court if eligible.

No class actions: You agree disputes will be brought only on an individual basis, and not as a class, collective, or representative action.

Arbitration provider and rules: Arbitration will be administered by a recognized arbitration provider (e.g., AAA) under its consumer rules.

Location: Arbitration will occur in add Caddo Parish, LA unless otherwise required by law or agreed by the parties.

Opt-out: You may opt out of arbitration within 30 days of purchase by emailing info@immunofithealth.comwith subject line “Arbitration Opt-Out” and your name + order details.
If any part of this clause is found unenforceable, the remainder will remain in effect.
22) Governing Law & Venue (If Arbitration Doesn’t Apply)
These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. If arbitration is found not to apply, exclusive venue will be state or federal courts located in Shreveport, LA, unless otherwise required by law.
23) Termination
We may suspend or terminate your access to the Services (and remove access to materials, communities, or platforms) if you:

Violate these Terms

Engage in abusive or fraudulent behavior

Misuse or distribute proprietary materials
Termination does not eliminate your obligation to pay amounts owed, and Sections that should survive (IP, liability limits, arbitration, etc.) will survive.
24) Changes to Services or Terms
We may update the Services and these Terms from time to time. The version in effect at the time of purchase applies to that purchase unless required otherwise by law. Continued use after updates means you accept the updated Terms.
25) Severability
If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
